1. About UrSocials
UrSocials ("UrSocials", "Company", "we", "us", or "our") is operated by Lachlan Henry Wainwright, an Australian sole trader trading as UrSocials (ABN 76 496 190 334), based in Queensland, Australia.
These Terms & Conditions ("Terms") govern your access to and use of our website at ursocials.com, related checkout pages, and the social content / scheduling product available at app.ursocials.com (together, the "Service").
By accessing or using any part of the Service, or by completing a purchase, you agree to be bound by these Terms. If you do not agree, do not use the Service.
Our Privacy Policy explains how we handle personal information and forms part of your agreement with us.
2. Eligibility
You must be at least 18 years old and legally capable of entering into a binding contract to use the Service. By using the Service, you confirm that you meet these requirements.
3. Account responsibilities
After purchase, we may provision an account and send access details (including a temporary password) to the email you provided at checkout. You are responsible for:
- Keeping your login credentials confidential
- Restricting access to devices you use to access the Service
- All activity that occurs under your account
- Updating your password promptly after first login where a temporary password was issued
If you suspect unauthorised access, email hello@ursocials.com immediately. We may suspend or terminate accounts that violate these Terms.
4. The Service
UrSocials provides tools to create, schedule, publish, and manage social content across platforms you connect, which may include AI-assisted captions, content, or image generation, media storage, analytics, and related workspace features. Exact features depend on the plan or add-ons you purchase and may change as we improve the product.
"Lifetime" access means ongoing access to the purchased plan features for as long as we continue to operate the Service in a commercially reasonable form, subject to these Terms. It is not a guarantee that every feature, credit allowance, third-party integration, or hosting arrangement will remain unchanged forever. We may update, replace, or discontinue features where necessary for operational, legal, security, or third-party reasons.
5. Third-party platforms and integrations
The Service may integrate with third-party platforms such as Facebook, Instagram, TikTok, LinkedIn, YouTube, X (formerly Twitter), and others. You acknowledge that:
- Access to those platforms is subject to their own terms, policies, and API rules
- We are not responsible for changes, limitations, outages, or discontinuations by third-party platforms
- API or policy changes may limit or break publishing, analytics, or account connections without liability on our part
- You are solely responsible for the content you schedule or publish and for complying with each platform's rules and applicable law
6. Acceptable use
You agree to use the Service only for lawful purposes and in a way that does not infringe the rights of, or unreasonably interfere with, others. You must not:
- Use the Service to send spam, unlawful, deceptive, or harmful content
- Violate any third-party platform terms, intellectual property rights, or privacy laws
- Attempt to reverse engineer, scrape, abuse, or disrupt the Service
- Share, resell, or sublicense your account access except as expressly permitted by an add-on you purchased (for example additional workspace capacity)
- Misuse AI features to generate unlawful or infringing content
7. Payments, pricing, and refunds
Prices for the lifetime offer and any optional add-ons are shown at checkout. Unless stated otherwise, prices are in US dollars (USD) and are one-time payments processed by Stripe (not a recurring subscription for the core lifetime offer).
We may adjust pricing for future purchases, introduce new charges, or change add-on offers at any time. Changes do not retroactively alter a purchase you have already completed, except where required by law.
Refund window. You may request a refund within 7 days of the purchase date by emailing hello@ursocials.com from the email used at checkout. After that 7-day window, purchases are generally non-refundable, subject to your non-excludable rights under the Australian Consumer Law.
Due to the nature of digital services and third-party platform dependencies, we do not guarantee uninterrupted service, specific growth outcomes, engagement results, or that any particular platform integration will remain available.
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy under the Australian Consumer Law that cannot lawfully be excluded.
8. AI features and credits
Some plans include AI text and/or image generation subject to monthly credit limits or fair-use controls. Credits reset or replenish according to the then-current plan rules and may change with reasonable notice where needed to keep the Service sustainable.
AI outputs may be inaccurate or unsuitable. You are responsible for reviewing all AI-generated content before publishing.
9. Your content
You retain ownership of content you upload or create in the Service ("Your Content"). You grant us a limited licence to host, process, transmit, and display Your Content solely as needed to operate the Service (including publishing to platforms you connect and generating AI outputs you request).
You represent that you have all rights necessary to use Your Content with the Service and that it does not violate law or third-party rights.
10. Intellectual property
The Service — including software, branding, logos, design, text, and other materials we provide — is owned by us or our licensors. You may not copy, modify, distribute, reverse engineer, or create derivative works from the Service except as expressly permitted in writing.
11. Support
Customer support is provided by email at hello@ursocials.com. We do not offer phone support, onboarding calls, or done-for-you / done-with-you setup services.
12. Service availability
We aim to keep the Service available but do not guarantee continuous, uninterrupted, or error-free operation. We may suspend, withdraw, or restrict all or part of the Service for maintenance, security, operational, or legal reasons without liability to the extent permitted by law.
13. No warranty
To the maximum extent permitted by law, the Service is provided on an "as is" and "as available" basis. We make no warranties, express or implied, regarding merchantability, fitness for a particular purpose, non-infringement, or that the Service will meet your expectations or achieve any particular result.
14. Limitation of liability
To the maximum extent permitted by Australian law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, goodwill, or business opportunity, arising out of or related to your use of the Service.
Where our liability cannot be excluded but can be limited, our total aggregate liability for claims relating to a purchase is limited to the amount you paid us for that purchase in the 12 months before the claim arose, or to re-supply of the services, at our option and to the extent permitted by the Australian Consumer Law.
Your sole and exclusive remedy for dissatisfaction with the Service, except for non-excludable consumer rights, is to stop using the Service and, where still within the refund window in section 7, request a refund.
15. Termination
You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms, misuse the Service, or if we discontinue the Service. On termination, your right to access the Service ends. Provisions that by their nature should survive (including intellectual property, limitation of liability, and governing law) will survive.
16. Changes to these Terms
We may update these Terms from time to time. The "Last updated" date will change when we do. Continued use of the Service after changes become effective constitutes acceptance of the updated Terms. If you do not agree, you must stop using the Service.
17. Governing law
These Terms are governed by the laws of Queensland, Australia. Subject to any non-excludable consumer rights, the courts of Queensland have exclusive jurisdiction over disputes arising from these Terms or the Service.
